A framework contract is required for a number of advisory services. A notice from the Official Journal of the European Union will be published and candidates for the framework will be selected on the basis of financial and economic capacity and technical capacity, including balance sheet and skills. Bids are then evaluated on the basis of “most economically advantageous”, including quality schemes and royalty rates. A number of companies are included in the framework that cover the range of consulting services needed. Hourly rates of different grades are part of the agreed conditions. Where it is necessary to obtain certain services within the framework, the contracting authority shall organise a mini-competition with all suppliers who are able to meet those needs with regard to the category of services required in order to determine which undertaking offers the `most economically advantageous` tender (quality/price ratio) for the mixture of the required grades/tariffs. A `framework agreement` is `an agreement between one or more contracting authorities and one or more economic operators the purpose of which is to define the conditions applicable to contracts to be awarded during a given period, in particular as regards the price and, where appropriate, the quantity provided for`. Framework agreements continue to play a central role in public procurement, including the possibility for boards to cooperate through central purchasing. The rules remain largely the same as before, including the maximum duration of four years.
This section describes a number of minor changes introduced by the new Regulations that clarify and improve the general functioning of framework agreements. A framework agreement is needed to cover the paper needs of a number of authorities over a four-year period. Following the opinion of the Official Journal of the European Union and the selection procedure based on financial and economic capacity and technical capacity, tenders are evaluated on the basis of `economically the most advantageous` for accession to the framework. A number of suppliers are included in the framework to provide a variety of pulps, simple, fed, recycled, colored, etc. – over a period of four years. The power is conferred on the supplier in the context where, on the basis of the initial award criteria, the tender is the “most economically advantageous” for each call required during the four years. Since it is not necessary to refine or supplement the conditions in this case, it is not necessary for the Authority to use the mini-competition option. Paragraph 4.9 of the Framework Agreement has been amended to correct the reference to paragraph 4.8. These examples are taken from the Office of Government Commerce`s “Framework agreements and EC developments”: The modular construction framework is the only national agreement of its kind….
